Success for Charlotte de Rosnay

Another great result for Charlotte de Rosnay. Last week she represented a client at Leamington Magistrates Court. The case had been ongoing since 2017 and involved a vulnerable witness as well as complicated areas of law. After months of meetings and preparation the case was finally dismissed on the day of trial. This was a great result for Charlotte after a lot of hard work.

Here is what her client said: “Thank you so much for all the work you put in. You went above and beyond, I couldn’t have done it without you. It’s such a weight off. You certainly don’t give up”.

Happy Clients and a Great Result for Lydia Etheridge

Lydia’s client faced trial for a serious ABH, domestic common assault, criminal damage x 2 to the value of £4500. A knife was brandished during the assaults.

He had pleaded guilty to all but the common assault at his first appearance but pleaded on a basis to the to common assault today at trial. Lydia managed to keep it in the Magistrates Court at Leamington Spa and he got a Suspended Sentence Order with 120 unpaid hours of work, compensation and a Victim Surcharge.

Both him and his step dad hugged Lydia after the hearing and said “you were excellent. What you said in there was just brilliant. I am so lucky this didn’t go to the Crown Court and I am so thankful that I can put this whole incident behind me and move on with my life. Thank you so much you were just excellent.”

Today Dean Phillips represented a very vulnerable client at Coventry Magistrates Court. Leading up to the day, she had been very nervous about her Court hearing and the likely outcome. She was in breach of a community order and did not know what to expect. However, as soon as she left the Court building today we received this message:

Dean Phillips joins John Onions Solicitors

Our new solicitor Dean Phillips has now joined John Onions. He can be seen in the Magistrates Courts and police stations around the Midlands and beyond.

He had an excellent result recently representing a private client at trial for a s172 failure to notify, after an alleged speeding offence. The verdict was not guilty as Dean proved the client had been diligent in attempting to find out who the driver was.

Pete Gotch in the Magistrates Court

We’ve had some more fantastic results in the Magistrates Courts recently. This time Pete Gotch travelled to Sevenoaks for a possession of firearms trial. The defence was reasonable excuse and after a long day the verdict came back as not guilty.

This is a great result and another happy client.

We recently represented a client at Leamington Spa Magistrates Court for the offence of Assault Occasioning Actual Bodily Harm. His case was sent to Coventry Crown Court for sentence where the case was adjourned for reports and due to his ill health.

Fantastic Feedback

As criminal defence solicitors it is fairly common to get to know our client’s families and partners well during the trial process. When someone is accused of a criminal offence, and especially if they are remanded as a result, it impacts their entire life.

We had a client recently who was remanded for 6 months on a domestic matter. The team at John Onions Solicitors worked tirelessly on his defence. More successes – Drink driving

Charlotte de Rosnay gets an excellent result at Leamington Spa Magistrates Court on a charge of drink driving. The case was blighted by CPS failures and terrible CCTV footage unable to identify the accused.

The client, who was of good character was able to return to his job as a lorry driver.

Legal aid challenge by Law Society – a Ray of light for justice system

The Law Society recently challenged the further cuts to legal aid in the criminal justice system and you can read more about the judicial review outcome and the Law Societies comments here.

The High Court quashed regulations due to implement severe cuts to payments for document heavy Crown Court cases.

Defence firms have faced huge cuts of up to 37% in document heavy cases, according to the Law Society, and in what is already a challenging market for criminal legal aid practitioners, this is an important ruling.

Another great result for Kate Hatton

Kate Hatton, one of our tenacious in-house barristers got an excellent result for a client last week.

Her client was convicted of stalking. He was made subject to a restraining order. This is common practice in cases involving stalking or matters of a domestic nature. However, the terms of an order do have to be reasonable and proportionate and not prevent the person subject to it from living their life.

The terms were agreed but then later drafted in a way that prevented her client from going to his own home and to his work. He could be arrested simply for being at home.

Kate spent an entire work day trying to rectify the problem. It was essential the case should be listed to rewrite the terms of the order so that the client wasn’t arrested, albeit lawfully but certainly unfairly.

Kate’s argument was that the order was in breach of his human rights and certainly not in the interests of justice.

Eventually she managed to get it heard as an urgent matter in court and the order was varied.

This is an excellent result as Kate not only ensured her client’s rights were protected but she did all of the work pro bono as the case was not covered by legal aid.
